All properties are sold "AS IS, WHERE IS" with no financing, inspection, or other contingencies to sale. AgriBuck Properties represents the seller of the property during the course of the sale by providing advertising, marketing, and auctioneering services. AgriBuck Properties has not performed any inspections of the property on behalf of you as the bidder. In the event you are the successful bidder, you will enter into a Contract for the Sale of Real Estate (the “Contract”) with the seller containing customary contractual terms for the geographic region of the property.   The terms of the Contract are non-negotiable.  Do not bid if you have not inspected the property or reviewed the Contract. By bidding you agree to these terms and conditions and the terms of the Contract. These terms and conditions and the Contract are incorporated by reference into your bidding.

DO NOT BID unless you have registered and have read and agreed to be bound by the terms of sale in the Contract as they are enforceable against you upon becoming the highest bidder. The successful bidder will be required to execute the Contract at the conclusion of the auction and submit ten percent (10%) of the bid price as down payment by the next day COB.  Upon registering to bid, the bidder shall provide AgriBuck Properties with a good faith or letter of credit and/or pre-approval letter from their financing institution noting necessary financing approval.

Upon closing of the sale, the buyer will receive a deed transferring record title to the buyer, as well as a Title Insurance Policy as provided by title company identified in the Contract.  The current year's real estate taxes shall be prorated through the day of closing as is customary and all previous year’s real estate taxes shall be paid by the seller.

The Contract will indicate the current acreage based upon the taxable acreage as determined by the County Assessor for where the property is located.  Bidders will submit a bid price per acre and the high bid will be the current acreage multiplied by the highest bid per acre. No survey will be provided by AgriBuck Properties and/or the seller.

The highest bidder shall sign the Contract and remit the 10% non-refundable down payment immediately following the conclusion of the auction.  The down payment shall be made payable to the title company designated in the Contract. Wire transfers and cashier's checks are accepted. Wire instructions will be coordinated with the title company at the conclusion of the auction. The balance of the purchase price and all closing costs are due within 30 days, unless otherwise noted in an addendum to the Contract entered into between buyer and seller upon mutually agreeable terms.

Bidding is open to the public. AgriBuck Properties reserves the right to handle the lots and scheduled sequence of bidding as they deem best in their sole discretion.  AgriBuck Properties may reject any bid which is only a fraction advance over the preceding bid, regulate bidding as it deems necessary, to accept or reject any or all bids, and to cancel or reschedule an auction. Absentee bids shall not be accepted. AgriBuck Properties is the sole controller of the conduct of the auction and shall be the final and absolute authority without liability to any party.
